Following suspension order of the Office of the Ombudsman, National Commission on Indigenous People (NCIP) Chairperson Zenaida Brigida Pawid ordered the two NCIP officials of Caraga Region to vacate office, relieved their responsibilities as NCIP officers and turned over all official documents, properties, gadgets in their possession to proper officers.
In the July 7, 2011 Order of Implementation issued and signed by Pawid copy furnished to all concerns, Pawid identified the NCIP officials suspended for one year without pay as Jose “Jake” Dumagan, Jr. former OIC NCIP-Caraga regional director who was recently recalled to his mother unit at the NCIP Provincial Office, Capitol Compound, Makilam, Tagum City
Pawid ordered Dumagan to vacate office.
Pawid also identified NCIP Surigao del Norte Provincial Officer Vicente Valdoza suspended for one year without pay and directed the NCIP regional office to implement the suspension order five days upon receipt of the order.
The suspension came into wake after some Mamanwa tribes headed by Mamanwa tribal chieftains Datu Alfredo Olorico and Datu Reynante Buklas filed in 2008 before Office of the Ombudsman for graft and abuse of authority charges against Dumagan, Baldoza, some NCIP Commissioners and other local NCIP personnel over conflict on their royalty fees from mining companies now occupying their ancestral lands in Taganito, Claver, Surigao del Norte.
They alleged the money deposited in a government bank amounting to millions of pesos could no longer be accounted for
PNA obtained copies of the NCIP Chairperson Pawid's implementation order dated July 7 but post marked received July 15 by the NCIP Caraga regional office.
Baldoza seeks TRO vs. Ombudsman Suspension Order
But Baldoza in his letter of appeal addressed to NCIP Caraga Regional Director Domingo Gomes wanted copies of the Ombudsman resolution to be attached in the NCIP implementation order.
In an interview, NCIP Caraga Regional Director Domingo Gomes told PNA the NCIP Caraga regional office did not received the Ombudsman Suspension Order but only the NCIP Chairman’s implementation order.
Gomes also admitted that at present Baldoza and former Agusan del Sur NCIP Provincial Officer Randy Rosas designated as replacement of Baldoza in the wake of Ombudsman suspension order are now the current NCIP Surigao del Norte provincial officers pending Baldoza’s appeal and Baldoza filing of Temporary Restraining Order (TRO) before local Surigao court.
“I understand Baldoza eventually will vacate the office, he is only there for smooth transition” Gomes said.
“Actually Baldoza was asking for copies of the Ombudsman Suspension Order including attachments of the Ombudsman case files which are basis for the suspension per his lawyer advise but we only received NCIP Chairperson Pawid’s implementation order” Gomes said. (PNA/ Ben Serrano)
